1. Agreement to Terms

By accessing or using J.C. Gury's website and services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.

These terms apply to all visitors, customers, and others who access or use our website and ordering services.

2. Products and Services

J.C. Gury manufactures custom signs, decals, and related products. All products are made to order based on customer specifications.

2.1 Custom Orders

Because our products are custom-made to your specifications, we require proof approval before production begins. Once you approve a proof, you accept responsibility for the accuracy of the design, text, colors, and dimensions.

2.2 Color Accuracy

While we strive for color accuracy, slight variations may occur due to differences in monitors, printing processes, and materials. We recommend requesting a physical sample for color-critical orders.

3. Ordering and Payment

3.1 Order Acceptance

All orders are subject to acceptance by J.C. Gury. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraud.

3.2 Pricing

All prices are quoted in US dollars. Prices are subject to change without notice. The price charged will be the price in effect at the time of order placement.

3.3 Payment Terms

Payment is due at the time of order unless otherwise arranged. We accept major credit cards, checks, and wire transfers for approved accounts. Net 30 terms are available for qualified business customers.

4. Proof Approval Process

Before production, you will receive a digital proof of your order. It is your responsibility to carefully review the proof for:

• Spelling and grammar
• Phone numbers and contact information
• Design layout and positioning
• Size and dimensions
• Color selections
• Quantity

Once you approve a proof, we are not responsible for errors that were present in the approved proof.Changes requested after proof approval may result in additional charges and production delays.

5. Production and Delivery

5.1 Production Time

Production times vary based on order complexity, quantity, and current workload. Estimated production times provided at the time of order are approximate and not guaranteed. Rush orders may be available for an additional fee.

5.2 Shipping

We ship via UPS, FedEx, or USPS. Shipping costs are calculated based on weight, dimensions, and destination and are added to your order total. Shipping dates and delivery times are estimates only and are not guaranteed.

5.3 Delivery

Risk of loss and title for products pass to you upon delivery to the carrier. We are not responsible for delays caused by carriers, weather, or other circumstances beyond our control.

6. Returns and Refunds

6.1 Defective Products

If you receive a product that is defective or does not match your approved proof, please contact us within 7 days of receipt. We will replace the product at no charge or provide a full refund.

6.2 Customer Errors

Because products are custom-made to your specifications, we cannot accept returns for errors that were present in your approved proof. This includes spelling errors, incorrect phone numbers, or design issues that were visible in the proof.

6.3 Cancellations

Orders may be cancelled without penalty before proof approval. Once a proof is approved and production has begun, cancellation may result in a restocking fee of up to 50% of the order value.

7. Intellectual Property

7.1 Your Content

You represent that you have the right to use any logos, images, or other content you provide for your order. You agree to indemnify J.C. Gury against any claims arising from your use of content you do not own or have rights to use.

7.2 Our Content

All content on this website, including text, graphics, logos, and images, is the property of J.C. Gury and is protected by copyright and trademark laws. You may not use our content without written permission.

8. Limitation of Liability

To the maximum extent permitted by law, J.C. Gury shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim arising from or related to these terms or your use of our services shall not exceed the amount you paid for the specific products giving rise to the claim.

9. Disclaimer of Warranties

All products are sold "as is" without any express or implied warranties. J.C. Gury makes no warranties regarding the merchantability, fitness for a particular purpose, or non-infringement of any products sold.

We stand behind the quality of our products. If you receive a product that is defective or does not match your approved proof, please contact us within 7 days of receipt and we will work with you to resolve the issue.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of New York.

11. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to this website. Your continued use of our services after changes are posted constitutes your acceptance of the modified terms.
